Resumo(s): | Com a revolução industrial, os problemas ambientais intensificaram-se, colocando os vários
Estados em alerta e a obrigá-los a tomar medidas para atenuar os seus efeitos. A utilização do sistema
tributário passou a constituir uma dessas medidas para assegurar o direito a um ambiente de vida
humano, sadio e ecologicamente equilibrado, consagrado na nossa Constituição.
Neste sentido, foi nosso objetivo analisar os tributos mais relevantes enquadrados nas quatro
categorias definidas pelo EUROSTAT: energia; transportes, poluição e recursos, bem como os benefícios
fiscais associados, suscetíveis de ter influência na proteção do Ambiente.
No âmbito destas quatro categorias, foi analisado: o Imposto sobre os Produtos Petrolíferos e
Energéticos e a Taxa sobre as Lâmpadas de Baixa Eficiência Energética, enquadrados na categoria da
energia; o Imposto sobre Veículos, o Imposto Único de Circulação e a recente Taxa de Carbono sobre as
Viagens Aéreas, Marítimas e Fluviais, associados à categoria dos transportes; a Taxa de Recursos
Hídricos, incluída na categoria dos recursos; e a Taxa de Gestão de Resíduos, as Prestações Financeiras
devidas a Entidades Gestoras de Fluxos Específicos de Resíduos, a Contribuição sobre os Sacos de
Plástico Leves, a Contribuição sobre Embalagens de Plástico ou Alumínio de Utilização Única em
Refeições Prontas e a Taxa de recolha de cadáveres de animais mortos na exploração agrícola, que
integram a categoria da poluição.
A todos estes tributos corresponde uma base tributável definida em função de um ato
perturbador do meio ambiente, pretendendo-se com a mesma, designadamente, diminuir as emissões
de dióxido de carbono, combater o problema da escassez de água ou reduzir a produção de resíduos.
Contudo, a análise a esta tributação demonstrou que não é fácil a implementação de uma
verdadeira tributação ambiental, da qual se ignore as questões sociais e económicas. Dado o caráter
difuso da poluição, é ainda difícil identificar o efetivo poluidor, assim como se apresenta de dificuldade
acrescida, definir uma base tributável que considere o custo real provocado.
Não obstante, a Taxa sobre as Lâmpadas de Baixa Eficiência Energética e a Contribuição sobre
os Sacos de Plástico Leves, face à receita residual que apresentam atualmente, revelaram-se tributos
aptos a mudar comportamentos em prol do ambiente. With the industrial revolution, environmental problems intensified, putting the various states on alert and forcing them to take measures to mitigate their effects. The use of the tax system became one of those measures to ensure the right to a humane, healthy and ecologically balanced living environment, enshrined in our Constitution. In this sense, it was our objective to analyze the most relevant taxes framed in the four categories defined by EUROSTAT: energy; transport, pollution and resources, as well as the associated tax benefits, likely to have an influence on the protection of the Environment. Within the scope of these four categories, the following were analyzed: the Tax on Petroleum and Energy Products and the Tax on Low Energy Efficiency Light Bulbs, framed in the energy category; the Vehicle Tax, the Single Circulation Tax and the recent Carbon Tax on Air, Sea and River Travel, associated with the transport category; the Water Resources Fee, included in the resources category; and the Waste Management Fee, the Financial Installments owed to Management Entities of Specific Waste Flows, the Contribution on Light Plastic Bags, the Contribution on Plastic or Aluminum Packaging for Single Use in Ready-to-Eat Meals and the Collection Fee dead animal corpses on the farm, which are part of the pollution category. All these taxes correspond to a taxable base defined in terms of an act that disturbs the environment, with the aim, namely, of reducing carbon dioxide emissions, combating the problem of water scarcity or reducing the production of waste. However, the analysis of this taxation showed that it is not easy to implement a true environmental taxation, which ignores social and economic issues. Given the diffuse nature of pollution, it is still difficult to identify the actual polluter, as well as it is even more difficult to define a taxable basis that considers the real cost caused. Nevertheless, the Tax on Low Energy Efficiency Light Bulbs and the Contribution on Light Plastic Bags, given the residual income they currently have, proved to be taxes capable of changing behavior in favor of the environment. |
