Resumo(s): | O acesso ao direito e à justiça é um direito constitucionalmente consagrado no artigo 20.º,
segundo o qual todos os cidadãos devem ter acesso ao direito e aos tribunais. Todavia, vários
estudos têm demonstrado que existem fortes discrepâncias entre a law in books e a law in action.
As desigualdades existentes na sociedade abrangem todas as instituições, inclusive os sistemas
de justiça criminal, influenciando diretamente o acesso efetivo ao direito e à justiça.
A presente investigação procura analisar, descrever e compreender as experiências, as
representações e as atribuições de sentido do acesso ao direito e à justiça. De forma
complementar tenciona-se analisar as dificuldades assim como os impactos do contacto com o
sistema de justiça. Pretende-se também explorar o tribunal enquanto palco do efetivo exercício de
acesso ao direito e à justiça. Deste modo, a exploração desta temática ambiciona incluir as
representações verificadas no tribunal, bem como as experiências e as atribuições de sentido das
vítimas de crime. Incorporar estas duas perspetivas, apesar de desafiadora, permite incluir
perspetivas de diferentes atores sociais.
Esta investigação ancora-se numa metodologia de caráter qualitativo. De modo a captar
diferentes ângulos, este estudo apoia-se em duas técnicas de pesquisa: a observação de 40
audiências no Tribunal Judicial da Comarca de Braga e a realização de 20 entrevistas
semiestruturadas a mulheres vítimas de crime apoiadas pela APAV, nomeadamente pelo GAV de
Braga e pelo GAV do DIAP de Braga.
Este estudo evidencia aspetos que conduzem à reflexão do acesso ao direito e à justiça.
Ainda existe um longo caminho a percorrer para que o real usufruto deste direito se concretize.
Destaca-se a incompreensão da linguagem e a não familiarização com os procedimentos jurídicos
e com o tribunal, bem como o afastamento entre os tribunais e os cidadãos. Access to law and justice is a constitutional right enshrined in article 20.º, according to which all citizens must have access to the law and the courts. However, several studies have shown that there are strong discrepancies between a law in books and a law in action. Inequalities encompass all existing institutions, including criminal justice systems, directly influencing the effectiveness of law and justice. The present investigation seeks to analyze, describe and understand the experiences, representations and meaning attributions of access to law and justice. In a complementary way, it is intended to analyze the difficulties as well as the impacts of contact with the justice system. It is also intended to explore the court as a stage for the effective exercise of access to law and justice. In this way, the exploration of this theme aims to include the representations verified in the court, as well as the experiences and the attributing meaning of the victims of crime. Incorporating these two perspectives, although challenging, allows to include perspectives from different social actors. This investigation is based on a qualitative methodology. In order to capture different angles, this study is based on two research techniques: the observation of 40 hearings at the Judicial Court of the District of Braga and the realization of 20 semi-structured interviews with women victims of crime supported by APAV, namely by GAV de Braga and by the GAV of the DIAP de Braga. This study shows aspects that lead to reflection on access to law and justice. There is still a long way to go for the real usufruct of this right to materialize. The misunderstanding of the language and the unfamiliarity with legal procedures and the court stand out, as well as the distance between the courts and the citizens. |
