Resumo(s): | A presente dissertação trata sobre a proteção jurídica contra a exploração do trabalho infantil da criança
migrante no direito internacional do trabalho à luz da Constituição Brasileira e da Carta de Direitos
Fundamentais da União Europeia. A pesquisa tem a intenção de fornecer maiores dados e informações, e por
consequência contribuir de maneira geral para uma melhor e mais ampla visão dos direitos das crianças e dos
adolescentes, tendo como um dos objetivos colaborar com os estudos já feitos no Brasil e na União Europeia, e
também acrescentar ao desenvolvimento de pesquisas na Universidade do Minho e no PPGD/UNISC, e também
do Grupo de Pesquisa em Direitos Humanos de Crianças, Adolescentes e Jovens que tem como seu projeto
institucional prioritário o estudo e pesquisa sobre políticas públicas de prevenção e erradicação do trabalho
infantil. O problema de pesquisa é: Considerando os fundamentos do direito internacional do trabalho, da
Constituição Brasileira e da Carta de Direitos Fundamentais da União Europeia como ocorre a proteção de
crianças e adolescentes migrantes contra a exploração do trabalho infantil? Seu objetivo geral é estudar a
proteção jurídica contra a exploração do trabalho infantil de crianças migrantes no direito internacional baseada
nos princípios e regras da Constituição Brasileira e da Carta de Direitos Fundamentais da União Europeia. O
método de abordagem é dedutivo e o método de procedimento monográfico com técnicas e pesquisa
bibliográfica e documental. Quanto a hipótese, as convenções 138 e 182 da OIT, a Constituição Federal e a
Carta de Direitos Fundamentais da União Europeia elevaram a idade mínima para laborar e aprimoraram as
políticas públicas de proteção para crianças, diminuindo assim, os casos de trabalho infantil. Os principais
resultados obtidos mostram que as normas que visam a proteção da criança e do adolescente, contra a
exploração do trabalho infantil, tem obtido bons resultados ao longo dos anos, pois o número de jovens
submetidos a essa prática diminuída desde então. Porém, ainda é necessário uma melhora nas ações para a
proteção das crianças e dos adolescentes na proteção de crianças migrantes. This dissertation deals with the legal protection against the exploration of child labor by migrant children in international labor law in the light of the Brazilian Constitution and the Charter of Fundamental Rights of the European Union. The research intends to provide more data and information, and consequently contribute in a general way to a better and broader vision of children's rights, having as one of the objectives to collaborate with the studies already done in Brazil and in the European Union, and also to add to the development of research at the University of Minho and at PPGD / UNISC, and also by the Research Group on the Human Rights of Children, Adolescents and Young People whose main institutional project is the study and research on public prevention policies and eradication of child labor. The research problem is: To analyze the foundations of international labor law, the Brazilian Constitution and the Charter of Fundamental Rights of the European Union, how does the protection of migrant children and adolescents against the exploitation of child labor occur? Its general objective is to study the legal protection against the exploration of child labor of migrant children in international law based on the principles and rules of the Brazilian Constitution and the Charter of Fundamental Rights of the European Union. The method of approach is deductive and the method of monographic procedure with techniques and bibliographic and documentary research. As for the hypothesis, ILO Conventions 138 and 182, the Federal Constitution and the Charter of Fundamental Rights of the European Union raised the minimum age for working and improved public policies for the protection of children, thus reducing the number of child labor cases. The main results obtained show that the norms that aim to protect children and adolescents, against the exploitation of child labor, have obtained good results over the years, since the number of young people submitted to this practice has decreased since then. However, there is still a need for improvement in actions to protect children and adolescents in the protection of migrant children. |
