A prova do crime de abuso sexual de menores: uma perspetiva crítica

Abstract

A presente dissertação tem como objeto de estudo a prova no crime de abuso sexual de menores, mais concretamente, a prova testemunhal e a prova pericial. Sabemos que o crime de abuso sexual contra menores não é um fenómeno raro na sociedade, mas por acontecer num contexto de intimidade onde se criam dinâmicas muito específicas, acaba por ser um crime oculto sem grande visibilidade. Trazendo algumas dificuldades à investigação criminal, nomeadamente à produção de provas que, consequentemente, dificulta a tomada de uma decisão judicial. Em relação ao testemunho da criança, este meio de prova apresenta-se envolto em grande controvérsia, uma vez que devido à dinâmica tipicamente oculta e secreta deste tipo de crime, apenas a vitima e o agressor tem conhecimento dos factos, sendo rara a ocorrência de confissão por parte do agressor e, na maior parte das vezes, não existem vestígios físicos ou biológicos, ou sequer evidências de ocorrência de abuso, que o exame médico-legal possa indicar, restando o testemunho da criança por ser o único meio de prova no qual se pode aferir a verdade material. Por outro lado, a perícia médico-legal tem uma elevada importância probatória, pois é através dos especiais conhecimentos técnicos, científicos ou artísticos do perito que se apuram factos novos que, de outra forma, não seriam trazidos para o processo e que podem ser imprescindíveis na solução do caso submetido a julgamento. Neste sentido realiza-se uma revisão da literatura publicada nacionalmente e internacionalmente quanto a estes os meios de prova, bem como analise à nossa jurisprudência e doutrina dominante.

The object of study of this dissertation is the evidence of crime in sexual abuse of minors, more specifically, the evidence of witnesses (the testimonial evidence) and expert evidence. It is known that the crime of sexual abuse of minors is not a rare phenomenon in today’s society, and since it happens in an intimate context, in which very specific dynamics are created, it turns out to be a hidden crime without great visibility, bringing some difficulties to criminal investigation, particularly the production of evidence, making it difficult to take a court decision. Regarding the testimony of the child, this evidence is quite controversial due to the usually hidden and secret dynamics of this type of crime and only the victim and the attacker have knowledge of the facts, being rare the offender's confession and, in most cases, there are no physical or biological residues, or even evidence of the occurrence of abuse that can be detected in forensic examination, leaving the child's testimony as the only evidence on which to assess the truth of the facts. On the other hand, the forensic expertise has a high probative value, because it is through special technical, scientific or artistic knowledge of the expert that new facts are detected, that otherwise wouldn’t be brought into the process, and which may be essential for the resolution of the case subjected to trial. Therefore, it was carried out a review of the literature published nationally and internationally, regarding these types of evidence, as well as the analysis of our jurisprudence and dominant doctrine.
