A União Europeia face à crise dos migrantes e refugiados: um ator dividido sob escrutínio

Abstract

Esta dissertação de mestrado pretende analisar de que forma a UE tem respondido à crise dos refugiados e migrantes desde a sua implosão com a Primavera Árabe. Para concretizar este objetivo, foi realizada uma análise dos desenvolvimentos efetuados nas áreas da migração e asilo, ao nível europeu. Foi também efetuada uma análise do posicionamento de determinados Estados Membros, sendo dado particular foco à Alemanha e ao Reino Unido, devido à sua relevância no plano europeu, e à Hungria devido ao seu protagonismo na crise. Esta investigação conclui que, porque foi apanhada na situação de joint decision trap, a UE revela-se incapaz de falar a uma só voz, assistindo-se à divisão da UE europeia na gestão da crise dos migrantes e dos refugiados, que fica evidente nas constantes fricções entre os Estados Membros que se mostram relutantes em contribuir para a edificação de uma resposta europeia. Devido à prevalência do intergovernamentalismo nas áreas de migração e asilo, as instituições comunitárias detêm pouca margem de atuação, face à contínua relutância dos Estados em delegar da sua soberania.

The present Master Thesis seeks to examine how the EU has been responding to the migrant and refugee crisis since its breakout following the Arab Spring. In order to achieve this objective, an assessment of the main achievements in the policy areas of migration and asylum, at the European level, has been realized. In addition, the performance of individual Member States, namely Germany and the United Kingdom, due to their relevance at the European level, and Hungary due to its protagonism in the crisis, has been explored. The main conclusion of this study is that due to the fact that the EU has been caught in the situation of joint decision trap, it has been unable to speak with one voice, heading towards the division of the EU in the matter of managing the migration and refugee crisis instead, which becomes manifest in the continuous discrepancies between Member States, who are reluctant to compromise in order to construct a European response. With the predominance of the intergovernmentalist approach in the areas of migration and asylum, the European institutions have little room of maneuver for action, given the Member States’ continuing reluctance to delegating their sovereignty.
