Resumo(s): | A tese doutoral aborda o tema da indeterminação das proposições normativas e a dificuldade de
se fixarem parâmetros seguros para a consequente interpretação judicial dos estatutos legais,
sobretudo no contexto de crise por que passam o direito positivo e a segurança jurídica nas jurisdições
contemporâneas, com destaque para os países de tradição romano-germânica e, em especial, Brasil e
Portugal. Desde o século XVIII, os exegetas buscam na lei formal a solução pronta, perfeita e acabada
para dirimir os problemas hermenêuticos que a concretização de preceitos jurídicos sempre suscitou.
Abandonando a ilusão de certeza da lei tão cultivada pelos adeptos da obsoleta Escola da Exegese, de
um lado, mas sem recair no ceticismo fomentado pelo realismo jurídico e por outras vertentes
antiformalistas, de outro lado, a tese busca encontrar um justo equilíbrio entre os extremos do
predeterminismo legal e do criacionismo judicial sem limites. Com efeito, o fenômeno do judicialismo,
antípoda que é do legalismo, transcendeu o common law e passou também a exercer implacável
influência nos regimes civilísticos, para se expandir no sistema judiciário brasileiro a cada ano com
maior intensidade, notadamente a partir da década de noventa do século passado, após a recepção
dos movimentos neoconstitucionalistas pela América Latina. Ao impactar o Brasil, essa nova onda
assumiu as feições desfiguradas de um sincretismo metodológico vulgar, que, a par de distorcer
teoricamente as bases conceituais do positivismo normativista e de subverter o âmago do pensamento
kelseniano, passou também a aglutinar, ao bastardo produto dessa distorção, arremedos da teoria
alexyana da ponderação, com vistas a libertar os intérpretes brasileiros de toda e qualquer amarra que
a lei ainda pudesse representar na adjudicação de direitos pela via judicial. Tal vaga esqueceu-se de
incorporar ao seu repertório, porém, as complexas fórmulas matemáticas, como a “weight formula”,
por exemplo, que Alexy a duras penas desenvolvera para subsidiar e validar cientificamente a sua
doutrina do sopesamento. O trabalho ora apresentado tenta mostrar as mazelas dessa recente
realidade judicial e propõe, ao final, alguns esboços contributivos para mitigar os problemas apontados. The doctoral thesis addresses the issue of the indeterminacy of normative propositions and the difficulty of establishing safe parameters for the consequent judicial interpretation of legal statutes, especially in the context of crisis that positive law and legal certainty are going through in contemporary jurisdictions, with emphasis on countries with a Romano-Germanic tradition and, in particular, Brazil and Portugal. Since the 18th century, exegetes have sought in formal law the ready, perfect and finished solution to resolve the hermeneutical problems that the implementation of legal precepts has always raised. Abandoning the illusion of certainty of the law so cultivated by followers of the obsolete School of Exegesis, on the one hand, but without falling back into the skepticism fostered by legal realism and other anti-formalist strands, on the other hand, the thesis seeks to find a fair balance between the extremes of legal predeterminism and unlimited judicial creationism. In effect, the phenomenon of judicialism, the antipode of legalism, transcended common law and also began to exert relentless influence on civil regimes, expanding in the Brazilian judicial system every year with greater intensity, notably from the nineties onwards of the last century, after the reception of neoconstitutionalist movements throughout Latin America. When it hit Brazil, this new wave took on the disfigured features of a vulgar methodological syncretism, which, as well as theoretically distorting the conceptual bases of normativist positivism and subverting the core of Kelsenian thinking, also began to add, to the bastardized product of this distortion, crude imitations of Alexy's theory of balancing, with a view to freeing Brazilian interpreters from any and all constraints that the law could still represent in the adjudication of rights by the courts. This wave forgot to incorporate into its repertoire, however, the complex mathematical formulas, such as the “weight formula”, for example, which Alexy had developed with great difficulty to subsidize and scientifically validate his balancing doctrine. The work presented here attempts to show the shortcomings of this recent judicial reality and proposes, at the end, some contributory approaches to mitigate the problems highlighted. |
