Resumo(s): | A presente Dissertação tem como primordial tarefa a da configuração, nos presentes tempos, da
responsabilidade do produtor, em face dos danos causados pelo advento da Inteligência Artificial e dos
sistemas da mesma derivados.
Para tal, dividimos o nosso estudo em três distintos, porém complementares, momentos.
Numa primeira parte, introduzindo a temática subjacente, abordaremos a evolução, o conceito,
as aplicações da Inteligência Artificial, a imprevisibilidade dos danos da mesma resultantes, bem como,
o longo e trabalhoso percurso desenvolvido, nesta sede, pela União Europeia. Após, levando a cabo um
estudo geral e abrangente do regime da responsabilidade do produtor -- plasmado no Decreto-Lei
383/89, de 06 de novembro, em resultado da transposição da Diretiva do Conselho 85/374/CEE, de
25 de julho de 1985 -- de imediato o aplicaremos aos danos ocasionados pelos sistemas de Inteligência
Artificial por forma a evidenciar as várias carências que o mesmo vem apresentando ao longo dos anos
e que são, por aquela tecnologia, potencializadas, como outras tantas que, de forma completamente
inovadora, são convocadas. Por fim, e como culminar das dificuldades enfrentadas, analisar-se-á a
bondade, frente aos problemas destacados, das alterações aduzidas pela Proposta de Diretiva relativa à
responsabilidade decorrente de produtos defeituosos, de 28 de setembro de 2022.
Com isto, concluir-se-á que o atual regime, pese embora os esforços adaptativos, enverga
dificuldades várias que a legislação futura, constituindo um bom e bem-sucedido ponto de partida,
certamente ultrapassará. The current dissertation has as primordial task the configuration, in present times, of the liability of the producer, in view of the damage caused by the advent of Artificial Intelligence and systems derived from it. To this end, we divided our study into three distinct but complementary moments. In the first part, introducing the underlying theme, we will address the evolution, concept, applications of Artificial Intelligence, the unpredictability of the damage resulting from it, as well as the long and laborious journey developed, in this headquarters, by the European Union. Afterwards, carrying out a general and comprehensive study of the producer liability regime - set out in Decree-Law 383/89, of November 6th, as a result of the transposition of Council Directive 85/374/CEE, of July 25th 1985 - We will immediately apply it to the damage caused by Artificial Intelligence systems in order to highlight the various shortcomings that it has been presenting over the years and that are enhanced by that technology, like many others that, in a completely innovative way, are called upon. Lastly, and as a culmination of the difficulties faced, the goodness will be analyzed, in view of the highlighted problems of the changes introduced by the Proposal for a Directive on liability arising from defective products, of September 28, 2022. With this, it will be concluded that the current regime, despite the adaptive efforts, faces several difficulties that future legislation, constituting a good and successful starting point, will certainly overcome. |
