Resumo(s): | A evolução tecnológica tem influenciado múltiplas vertentes do conhecimento, moldando o
modo como os humanos interagem, comunicam e se interrelacionam em sociedade. A
substituição tecnológica de Homens por sistemas de inteligência artificial é uma ideia que tem
ganho maior expressão, tornando-se, portanto, premente a reflexão sobre os seus contornos
no contexto da tomada de decisão judicial. O exercício da magistratura é uma área de elevada
complexidade, que entrelaça capacidades emocionais e cognitivas, surgindo o presente
estudo como resultado de uma pergunta: pode o juiz humano vir a ser substituído por um juiz
robot? Esta dissertação parte de uma predisposição para o desassossego tecnológico,
motivada pela carência de literatura nacional sobre a temática, que justifica a inovação e
pertinência do objeto de estudo, tendo como ponto de partida uma situação problemática,
complexa e comum a variados sistemas judiciais, que aglomeram morosidade processual,
escassez de recursos humanos e custos excessivos. O objetivo da dissertação é identificar o
conceito de juiz robot, enquanto conceito interdimensional, decorrente da miscelânea entre
o direito adjetivo e a inteligência artificial, visando, por conseguinte, analisar e desenvolver
este fenómeno à luz da doutrina e experiências práticas concretas. Ao longo do estudo,
mediante a análise do estado de arte e problemáticas jurídicas que envolvem esta temática,
constatamos que a IA pode trazer contributos para a administração do sistema judicial
moderno e pode funcionar como uma ferramenta útil para auxiliar o trabalho dos juízes
humanos. Contudo, à luz do atual desenvolvimento tecnológico e das diversas problemáticas
jurídicas emergentes desta conceptualização, refutamos o juiz robot como um substituto do
juiz humano, finando o estudo pela apresentação de um conjunto de recomendações gerais e
específicas. Technological evolution has multiple aspects of knowledge, shaping the way humans interact, communicate and interrelate in society. The substitution of Men by artificial intelligence systems is an idea that has gained greater expression, thus becoming appropriate to reflect on the contours in the context of judicial decision-making. The exercise of the judiciary is an area of high complexity, which was invoked emotional and cognitive, arising the present study because of a question: can the human judge be replaced by a judge robot? This thesis starts from a predisposition to technological restlessness, motivated by the lack of national literature on the subject, which justifies the innovation and pertinence of the object of study, with the starting point a problematic situation, complex and common to various judicial systems, which agglomerate procedural delay, scarcity of human resources and excessive costs. The objective of the dissertation is to identify the concept of robot judge, as an interdimensional concept, resulting from the miscellany between adjective law and artificial intelligence, aiming, therefore, to analyze and develop this phenomenon in the light of doctrine and concrete practical experiences. In the long course of study, through the analysis of the state of the art and legal problems that involve this theme, we found that AI can bring contributions to the administration of the modern judicial system and can function as a useful tool to assist the work of human judges. However, in the light of the current state of technological development and the new legal problems emerging from this conceptualization, we refute the robot judge as a substitute for the human judge, fining the study by presenting a set of general and specific recommendations. |
