Tráfico de pessoas nas decisões judiciais em Portugal: da especial vulnerabilidade ao testemunho da vítima

Abstract

O tráfico de pessoas é um fenómeno complexo ainda pouco estudado em Portugal, principalmente acerca do papel da vítima em Tribunal. O presente estudo visa analisar as decisões judiciais de tráfico de pessoas proferidas entre 2018 e 2019, nomeadamente, quanto às dinâmicas criminais, ao impacto do crime, à especial vulnerabilidade da vítima e à importância dada ao seu testemunho no desfecho judicial. Este estudo baseou-se numa análise qualitativa de oito decisões judiciais. Os resultados mostram que, primeiro, a motivação mais comum dos arguidos foi o benefício financeiro, o tipo de exploração mais comum foi a exploração laboral e o tráfico internacional, a maioria das vítimas e dos arguidos eram homens adultos e a maioria das vítimas eram desconhecidas dos seus recrutadores/exploradores; segundo, a maioria das vítimas recebeu o estatuto de especial vulnerabilidade, no entanto, existem lacunas de informação acerca dos dados sociodemográficos, dos fatores de risco, do impacto e dos danos causados; terceiro, o desfecho do julgamento é, maioritariamente, independente do testemunho (in)coerente das vítimas. Este estudo reforça a importância de analisar o papel da vítima no processo judicial, de modo a evitar a revitimização e a compreender o impacto do crime de tráfico de pessoas nas vítimas.

Human trafficking is a complex phenomenon that is still poorly studied in Portugal, particularly regarding the role of the victim in court. The present study aims to analyze the judicial decisions on human trafficking rendered between 2018 and 2019, specifically regarding criminal dynamics, the impact of the crime, the special vulnerability of the victim, and the importance given to their testimony in the judicial outcome. This study was based on a qualitative analysis of eight judicial decisions. The results show that, first, the most common motivation of the defendants was financial gain, the most common type of exploitation was labor exploitation, and the majority of victims and defendants were adult males, with most victims being unknown to their recruiters/exploiters; second, the majority of victims were recognized as having a special vulnerability status, however, there are gaps in information regarding sociodemographic data, risk factors, impact, and harm caused; third, the outcome of the trial is mostly independent of the (in)consistent testimony of the victims. This study reinforces the importance of analyzing the role of the victim in the judicial process to avoid revictimization and understand the impact of the crime of human trafficking on the victims.
