Resumo(s): | Em poucos momentos da história o direito fiscal se revelou tão importante como nos tempos
atuais. Isto não é por acaso, pois com a reconfiguração progressiva do papel do Estado,
nomeadamente a partir do fim da idade média, a fiscalidade passou a ser o centro das
preocupações não apenas para os agentes públicos ligados ao Estado fiscal, mas também
para os contribuintes, porque, a partir de um pacto político, simplificadamente aqui como
contrato político-social, estes se comprometeram a contribuir para a manutenção do próprio
Estado fiscal-social. Ocorre que, fenômenos como a internacionalização (globalização) dos
mercados, circulação rápida de riquezas, e agora principalmente com velocidade,
abrangência e profundidade das novas tecnologias, as bases e manifes tações da economia
vem passando por mudança sérias. A aplicação do direito fiscal (um direito de sobreposição),
que foi pensada para um mundo material/físico, vem revelando crises diante dessa nova
realidade, como no caso da tributação dos rendimentos empresariais na economia da
informação. É neste sentido, e olhando para a difusão de poder, corrosão da soberania e
autoridade dos Estados fiscais pelas grandes empresas do segmento, que se busca com a
presente dissertação identificar crises de aplicação das regras fiscais, neste quadro já muito
alterado pela desmaterialização das relações para, a partir daí, tentarmos contribuir no
encontro de respostas ao questionamento se o Estado fiscal cumprirá ou não o seu papel
assumido, ao menos no âmbito interno dos Estados Membros da União Europeia. In a few moments in the history, tax law has revealed itself as important as it is today. The reason is that, considering the progressive reconfiguration of the role of the State, namely from the end of the Middle Ages, taxation became the center of concerns not only for public agents linked to the State, but also for taxpayers, because a political pact, simplified here as a political-social contract, they pledged to contribute to the maintenance of the fiscal-social State, too. It happens that, the globalization of markets, rapid circulation of wealth, and nowaday mainly with the speed, scope and depth of technologies, over the economy have been undergoing serious change. The application of tax law (an overlapping law), which was designed for a material/physical world, has revealed crises in the face of this new reality, as in the case of corporate income taxation in the information economy. It is in this way, and looking at the diffusion of power, erosion of the sovereignty and authority of the tax States by the large companies in this ecosystem, that the present dissertation seeks to identify crises in the application of tax rules, in this framework that has already been greatly altered by the dematerialization of relations to, from there, try to contribute to finding answers to the question whether the fiscal State will fulfill its assumed role or not, at least within the internal scope of the Member-States of the European Union. |
