Resumo(s): | Esta investigação de título “O advogado e a intervenção tutelar educativa – desafios e
potencialidades”, tem por base a análise do papel do advogado no PTE, em ordem a perceber que as
dificuldades que surgem quanto à determinação da verdadeira função do advogado neste processo
derivam da sua similitude com o PP, bem como da equiparação do estatuto do menor ao estatuto do
arguido, na vertente dos direitos. Assim, explorar-se-á quais as soluções possíveis para cessar esta
dificuldade, ficando determinada a verdadeira função do advogado no PTE.
De facto, o fenómeno da delinquência juvenil é uma realidade que tem de ser combatida com a
intervenção do Estado, através de um PTE.
Todavia, dada à nova conceção de criança como sujeito de direitos e não como “adultos
imperfeitos”, é necessário que a intervenção do Estado obedeça aos requisitos previstos e regulados na
LTE, que estabelece mecanismos no sentido de alterar o percurso de vida dos jovens, entre os 12 a 16
anos, que entram no mundo da delinquência.
Neste sentido, além de reconhecer expressamente que a sua finalidade é a educação do menor
para o Direito, a LTE reconhece ao menor, sujeito de um PTE, um conjunto de direitos processuais
equivalentes aos direitos processuais do arguido em PP. Ora, ao longo desta exposição, veremos que a
finalidade de educar o menor para o direito e a concretização dos seus direitos processuais, por vezes
conflituam, surgindo a questão de saber, qual deverá ser o foco da defesa do advogado num PTE?
deverá ser a concretização dos direitos processuais do menor? Ou deverá ser a educação do menor
para o Direito? This research entitled "The lawyer and the educational tutelary intervention - challenges and potentialities", is based on the analysis of the role of the lawyer in the Educational Guardianship Process, in order to understand that the difficulties that arise as to the determination of the true function of the lawyer in this process derive from its similarity with the Criminal Process, as well as from the equation of the status of the minor to the status of the defendant, as far as rights are concerned. Therefore, we will explore the possible solutions to overcome this difficulty and to determine the true function of the lawyer in the Educational Guardianship Process. In fact, the juvenile delinquency phenomenon is a reality that must be fought against with the intervention of the State, by means of an Educational Guardianship Process. However, given the new conception of the child as a subject of rights and not as "imperfect adults", it is necessary that the State intervention obeys the requirements foreseen and regulated in the Educational Guardianship Law, which establishes mechanisms in order to change the life path of young people, between 12 and 16 years old, who enter the world of delinquency. In this sense, besides expressly recognizing that its purpose is the education of the minor to the Law, the Educational Guardianship Law recognizes to the minor, subject of an Educational Guardianship Process, a set of procedural rights equivalent to the procedural rights of the defendant in Criminal Process. Now, along this exposition, we will see that the purpose of educating the minor to the law and the accomplishment of his procedural rights, sometimes conflict, raising the question of knowing, what should be the focus of the lawyer's defence in an Educational Guardianship Process? should it be the accomplishment of the minor's procedural rights? Or should it be the education of the minor in the Law? |
