O Regulamento (EU) 2016/679: algumas notas sobre o encarregado de protecção de dados

Abstract

A presente dissertação tem como objectivo discorrer sobre uma das principais obrigações introduzidas pelo Regulamento (EU) 2016/679: a obrigação legal de, verificados certos pressupostos, nomear um Encarregado de Protecção de Dados (doravante, EPD). Inicialmente, faremos uma breve descrição da evolução do direito à protecção de dados pessoais e abordaremos as principais alterações introduzidas pelo novo diploma legal, dando nota do modo como este tem sido aplicado e integrado no ordenamento jurídico português. Posteriormente, dedicaremos o nosso estudo à caracterização do papel e das funções do EPD. Na medida do possível, pretendemos caracterizar a relação contratual estabelecida entre o EPD e o responsável pelo tratamento ou subcontratante, indagando sobre a possibilidade de este ser responsabilizado civilmente quer perante estes sujeitos, quer perante os titulares dos dados pessoais. Na última parte desta investigação, indagaremos sobre a possibilidade de o EPD ser responsabilizado criminalmente bem como estar sujeito ao quadro sancionatório previsto no Regulamento.

This dissertation aims to focus on one of the main obligations introduced by Regulation (EU) 2016/679: the legal obligation to appoint a data protection officer, when certain assumptions are met. Initially, we will briefly describe the evolution of the right to personal data protection and discuss the main changes introduced by the new regulation, noting how it has been applied and integrated in the Portuguese legal system. Subsequently, we will dedicate our study to the characterization of the role and functions of the Data Protection Officer. As far as possible, we intend to characterize the contractual relationship established between the DPO and the controller or processor, inquiring about the possibility of him being liable before these subjects and before the data subjects. In the final part of this investigation, we will consider the possibility of the DPO being held criminally liable and subject to the administrative fines provided for in the Regulation.
