El derecho al beneficio del progreso científico y sus aplicaciones: contribución a su contenido y reconciliación con los derechos de propiedad intelectual

Abstract

En la emergencia global por la pandemia del coronavirus que alcanzó a casi todos los países del planeta durante el 2020, la humanidad entera pudo observar como las posibilidades de evitar el contagio o de superar la enfermedad dependían principalmente de las medidas a tomarse basadas en el conocimiento y los avances científicos. Esta trágica coyuntura muestra la trascendencia de que las personas puedan gozar del beneficio del progreso científico y sus aplicaciones para satisfacer su derecho a la salud. Aunque aquel derecho no se limita a esto, cumple una función mediadora para el goce de muchos otros derechos humanos y por ello su desarrollo conceptual y de aplicación es necesario. Esta investigación se enfoca en el contenido y aplicación del derecho a gozar del beneficio del progreso científico y sus aplicaciones reconocido tanto la Declaración Universal de Derechos Humanos de 1948, el Pacto Internacional de Derechos Económicos Sociales y Culturales (PIDESC), la Declaración Americana de los Derechos y Deberes del Hombre y el Protocolo Adicional a la Convención Americana sobre Derechos Humanos en materia de Derechos Económicos Sociales y Culturales (Protocolo de San Salvador); así como, en las tensiones entre el derecho al goce del beneficio del progreso científico y sus aplicaciones y el régimen de propiedad intelectual y las oportunidades para su reconciliación. Los métodos utilizados son el deductivo, el analítico-sintético, a través del análisis de fuentes documentales primarias, tales como los instrumentos internacionales, documentos de órganos, comités, comisiones, relatorías internacionales sobre el derecho a la ciencia y fuentes secundarias a través de bibliografía especializada de diverso origen que permita el diálogo entre diferentes perspectivas y disciplinas. Este ejercicio es enriquecido inductivamente a través de la comparación del estado del derecho a la ciencia y su relación con el régimen de propiedad intelectual, en el Derecho interno de un grupo de Estados, con el propósito de aproximarse a la comprensión que los Estados tienen sobre el contenido de este derecho y sus obligaciones. Finalmente, la investigación alcanza algunas conclusiones que no pretenden agotar el tema, sino que abren nuevas interrogantes para futuros trabajos centrados en encontrar soluciones a las tensiones y de esta manera facilitar el respeto, protección y realización del derecho al goce del beneficio del progreso científico y sus aplicaciones.

In the global emergency caused by the coronavirus pandemic that reached almost every country on the planet in 2020, the whole of humanity was able to observe how the chances of avoiding contagion or overcoming the disease depended primarily on the measures to be taken based on scientific knowledge and progress. This tragic juncture shows how important it is for people to be able to benefit from scientific progress and its applications to satisfy their right to health. Although that right is not limited to this, it plays a mediating role for the enjoyment of many other human rights and therefore its conceptual development and application is necessary. This research focuses on the content and application of the right to enjoy the benefits of scientific progress and its applications recognized in the 1948 Universal Declaration of Human Rights, the International Covenant on Economic, Social and Cultural Rights (ICESCR), the American Declaration of the Rights and Duties of Man and the Additional Protocol to the American Convention on Human Rights in the Area of Economic, Social and Cultural Rights (Protocol of San Salvador), as well as on the tensions between the right to enjoy the benefits of scientific progress and its applications and the intellectual property regime and the opportunities for its reconciliation. The methods used are deductive, analytical-synthetic, through the analysis of primary documentary sources, such as international instruments, documents of bodies, committees, commissions, international rapporteurships on the right to science, and secondary sources through specialized bibliography of diverse origin that allows for dialogue between different perspectives and disciplines. This exercise is inductively enriched through a comparison of the situation of the right to science and its relationship with the intellectual property regime in the domestic law of a group of States, with the aim of approaching the understanding that States have of the content of this right and their obligations. Finally, the research reaches some conclusions that are not intended to exhaust the subject, but rather to open up new questions for future work focused on finding solutions to the tensions and thus facilitate the respect, protection and realization of the right to the enjoyment of the benefits of scientific progress and its applications.
