Resumo(s): | A presente Dissertação está inserida na Linha de Pesquisa de Direito Ambiental, Transnacionalidade e
Sustentabilidade, na Área de Concentração dos Fundamentos do Direito Positivo, do Curso de
Mestrado em Ciência Jurídica, vinculado ao Programa de Pós-Graduação Stricto Sensu em Ciência
Jurídica, da Universidade do Vale do Itajaí (UNIVALI), do Brasil, e ao Curso de Mestrado em Direito da
União Europeia, da Universidade do Minho (UMINHO), de Portugal. Neste trabalho escrito analisam-se
as normas jurídicas concernentes à temática da contaminação, por Agrotóxicos, no Brasil, e por
Pesticidas, na União Europeia, da Água Tratada e dos Alimentos Seguros para consumo humano,
especialmente daqueles alimentos de origem vegetal, diante dos Objetivos do Desenvolvimento
Sustentável (ODS), tal como concebidos pela Organização das Nações Unidas, para integrarem o plano
de ação a ser adotado por seus 193 Estados-Membros, para os anos de 2015 até 2030, com o fim de,
ao fazê-lo, serem identificados os Desafios Regulatórios colocados hodiernamente às agências
regulatórias do Brasil e da União Europeia. No contexto da atual Sociedade Globalizada de Riscos
Hídricos e Alimentares transnacionais e à luz dos lineamentos doutrinários, dos repertórios legislativos,
dos compromissos internacionais e intraeuropeus estabelecidos, examinam-se os preceitos relativos ao
direito à vida, ao direito à dignidade da pessoa humana, ao direito à água potável e ao direito à
alimentação. Verifica-se a adoção de tais mecanismos jurídicos para atingir a máxima efetividade
jurídica possível, com vista à obtenção da exequibilidade da consecução integral do cumprimento dos
Direitos Humanos e Fundamentais à Água Potável e ao Alimento Seguro e à obtenção, ainda, da
eficácia de cinco dos 17 Objetivos do Desenvolvimento Sustentável (ODS) estabelecidos na Agenda
2030 das Nações Unidas, a saber: o Objetivo do Desenvolvimento Sustentável sobre Fome e
Agricultura Sustentável (ODS n.º 2); o Objetivo do Desenvolvimento Sustentável sobre Vida Saudável
(ODS n.º 3); o Objetivo do Desenvolvimento Sustentável sobre Água e Saneamento (ODS n.º 6); o
Objetivo do Desenvolvimento Sustentável sobre Consumo Sustentável (ODS n.º 12), e, ainda, o Objetivo
do Desenvolvimento Sustentável sobre Ecossistemas e Perda de Biodiversidade (ODS n.º 15). Com
relação à Metodologia, foram utilizados: o Método Indutivo na Fase de Investigação, o Método Analítico
na Fase de Tratamento dos Dados e novamente o Método Indutivo no Relatório dos Resultados
consagrados na presente Dissertação. Foram empregadas ao longo das fases referidas, as técnicas do
Referente, da Categoria, dos Conceitos Operacionais e da Pesquisa Bibliográfica. This Dissertation is part of the Environmental Law, Transnationality and Sustainability Research Line, in the Concentration Area of the Fundamentals of Positive Law, of the Master's Course in Legal Science, linked to the Stricto Sensu Graduate Program in Legal Science, at the University from Vale do Itajaí (UNIVALI), from Brazil, and to the Master's Course in European Union Law, from the University of Minho (UMINHO), from Portugal. This written work analyzes the legal norms concerning the theme of contamination by Pesticides in Brazil and the European Union, of Treated Water and Safe Food for human consumption, especially those foods of plant origin, given the Objectives of Sustainable Development (SDG), as conceived by the United Nations, to integrate the action plan to be adopted by its 193 Member States, for the years 2015 to 2030, to regulatory challenges currently posed to regulatory agencies in Brazil and the European Union are identified. In the context of the current Global Society of transnational Water and Food Risks and light of the doctrinal guidelines, legislative repertoires, established international and intra-European commitments, the precepts relating to the right to life, the right to human dignity, to the right to clean water and the right to food. The adoption of such legal mechanisms is verified to achieve the maximum legal effectiveness possible, to obtain the feasibility of fully achieving the fulfilment of the Human and Fundamental Rights to Drinking Water and Safe Food and also getting the effectiveness of five of the 17 Sustainable Development Goals (SDGs) established in the 2030 Agenda of the United Nations, namely: the Sustainable Development Goal on Hunger and Sustainable Agriculture (SDG No. 2); the Sustainable Development Goal on Healthy Living (SDG No. 3); the Sustainable Development Goal on Water and Sanitation (SDG No. 6); the Sustainable Development Goal on Sustainable Consumption (SDG #12), and the Sustainable Development Goal on Ecosystems and Biodiversity Loss (SDG #15). Regarding the Methodology, the following were used: the Inductive Method in the Investigation Phase, the Analytical Method in the Data Processing Phase and the Inductive Method in the Report of Results enshrined in this Dissertation. During the referred phases, the techniques of Referent, Category, Operational Concepts and Bibliographic Research were used. |
