Resumo(s): | O objeto primordial da presente dissertação prende-se com a compreensão acerca da compatibilidade
entre dois ramos de Direito – Penal e Fiscal -, por forma a descortinar a possibilidade de utilizar métodos
legalmente previstos e admissíveis no âmbito da legislação tributária para dar como provados factos penalmente
relevantes. Para tanto, analisaremos a legislação aplicável, a jurisprudência dos Tribunais Superiores, nacional e
internacional, bem como a doutrina relevante.
Concretamente, e em termos objetivos, o que se pretende concretizar, a final, é se a matéria coletável
determinada através de métodos indiretos poderá relevar para efeitos de preenchimento do tipo objetivo de ilícito
do crime de fraude fiscal, p.p. pelo art. 103.º do R.G.I.T., e, em caso afirmativo, em que termos. Para tanto, numa
primeira fase será efetuada uma análise ao Direito Fiscal, enquanto sub-ramo do Direito Tributário, no qual relevam
os princípios aplicáveis que se afiguram relevantes, nomeadamente que se encontram subjacentes à incidência
do imposto, as finalidades dos impostos, o enquadramento dos comportamentos adotados pelos sujeitos passivos
da relação jurídico-tributária em face da legislação aplicável, os deveres a que se encontram adstritos e, no final,
os métodos de determinação de matéria tributável. Desta forma, poderemos compreender os fundamentos, os
pressupostos e as finalidades dos métodos indiretos de determinação de matéria coletável, bem como a sua
legalidade.
Em contraposição, numa segunda fase será efetuada então uma análise ao ramo do Direito Penal, no
qual relevam os princípios aplicáveis que se afiguram relevantes, nomeadamente que se encontram subjacentes
ao comportamento do Arguido e suas consequências, as finalidades das penas, o bem jurídico enquanto objeto
de tutela e, dentro deste, os crimes tributários e as teses a si referentes, concluindo com uma sucinta qualificação
do crime de fraude fiscal e a análise do bem jurídico por si tutelado. Desta forma, poderemos compreender os
fundamentos, os pressupostos e as finalidades subjacentes à criminalização das condutas previstas no art. 103.º
do R.G.I.T., sob epígrafe “Fraude Fiscal”.
Analisados estes dois ramos de Direito nos termos enunciados, passamos então a analisar a atividade
probatória, com especial incidência sobre a prova, as presunções e os ónus da prova, concretizando as
peculiaridades inerentes ao objeto de análise nos dois capítulos anteriores.
Aqui chegados, em capítulo autónomo evidenciaremos então a relevância das presunções tributárias para
efeitos criminais, por forma a conseguir responder à questão essencial: podem os métodos indiretos de
determinação de matéria coletável determinar o preenchimento do tipo objetivo de ilícito, previsto no art. 103.º do R.G.I.T. sob epígrafe “Fraude Fiscal” e, se sim, em que termos? The main object of this dissertation is to understand the compatibility between the branches of Law - Criminal and Tax -, in order to unveil the possibility of using legally foreseen and admissible methods under the tax legislation to give as proven criminal facts relevant. For that, we will analyse the applicable legislation, the jurisprudence of the Superior Courts, both national and international, as well as the relevant doctrine. Concretely, and in objective terms, what is intended to materialize, in the end, is whether the taxable amount determined through indirect methods may be relevant for the purposes of filling in the objective type of illicit crime of tax fraud, p.p. by art. 103 of the R.G.I.T., and, if so, on what terms. For this purpose, in a first phase, an analysis of Tax Law will be carried out, in which the applicable principles that are relevant are highlighted, namely those underlying the incidence of the tax, the purposes of the taxes, the framework of the behaviour adopted by the taxpayers, the duties to which they are attached and, in the end, the methods for determining the taxable matter. In this way, we will be able to understand the fundamentals, assumptions and purposes of indirect methods for determining taxable income, as well as their legality. In contrast, in a second phase, an analysis will then be made to the branch of Criminal Law, which highlights the applicable principles that are relevant, namely that they underlie the Defendant's behaviour and its consequences, the purposes of the penalties, the legal interest as object of tutelage and, within it, the tax crimes and the theses referring to them, concluding with a succinct qualification of the crime of tax fraud and the analysis of the legal interest protected by it. In this way, we will be able to understand the foundations, assumptions and purposes underlying the criminalization of the conduct provided for in art. 103 of the R.G.I.T., under the heading "Tax Fraud". Having analysed these two branches of Law in the terms set out, we then began to analyse the evidentiary activity, with special focus on the evidence, the presumptions and the burden of proof, realizing the peculiarities inherent to the object of analysis in the two previous chapters. Having arrived here, in an autonomous chapter, we will then highlight the relevance of tax presumptions for criminal purposes, in order to be able to answer the essential question: can indirect methods of determining taxable income determine the fulfilment of the objective type of tort, provided for in art. 103 of the I.T.R.G. under the heading “Tax Fraud” and, if so, in what terms? |
