Resumo(s): | O procedimento tributário corresponde a um conjunto sequencial e ordenado de atos,
legalmente e cronologicamente estabelecidos, cujo término está direcionado para uma decisão
de um órgão administrativo determinado. Tradicionalmente, este procedimento tributário é
assente numa base burocrática, manual e baseada nos recursos humanos que integram a
Administração Tributária, estando esta incumbida de aplicar as normas fiscais, por via dos
vários procedimentos que integram o sistema de gestão fiscal.
Contudo, os sistemas de gestão fiscal clássicos - cujos atos são direcionados,
eminentemente, para a supervisão e controlo de riquezas internas -, revelam-se ultrapassados e
insuficientes, em virtude dos novos desafios operados pela globalização, a abertura de
mercados e o aproveitamento de medidas fiscais mais vantajosas. Por isso, torna-se necessário
dar cumprimento às exigências constitucionais que legitimam a integração de instrumentos
inovadores e baseados nas novas tecnologias de informação e comunicação. Neste sentido, a
adoção por sistemas de inteligência artificial, permite dar cumprimento aos desideratos
prosseguidos pela administração, reformulando a sua atividade funcional e os vários
procedimentos vigentes.
A legitimação dada pela integração de sistemas inteligentes, não pode, contudo, deixar
de proteger e promover os direitos dos obrigados tributários. É que, perante um Estado de
Direito Democrático, baseado na dignidade da pessoa humana, a "coisificação" dos
contribuintes é um limite intransponível e inalienável. As tensões, as problemáticas e os
desafios operados perante os interesses que são colocados em jogo, são suficientes para
admitir a necessidade de um estudo e de uma discussão sobre a integração de sistemas
inteligentes no procedimento tributário, sobre a reformulação da atividade funcional da
administração e os limites que devem ser considerados na adoção de sistemas de inteligência
artificial. The functional activity of the Tax Administration corresponds to a modelled set of acts, legally and chronologically established, for the achievement of a result expressed by the competent administrative body. Traditionally, the tax procedure that legally covers the set of acts performed by the administration is based on a bureaucratic, manual, and human resource-based basis within this administrative body. On the other hand, the activity of the administration is geared towards conducting internal acts and answering questions raised within the scope of the legal-tax relations established. The classic legal models that are faced with an internal geography and based on traditional manual activity are outdated and insufficient according to the new challenges arising from globalization, the opening of markets and the use of more advantageous tax measures. Therefore, it becomes necessary to comply with the constitutional requirements that legitimize the integration of innovative instruments based on new information and communication technologies. The adoption of artificial intelligence systems applied to the tax management system enables compliance with the objectives pursued by the administration, reformulating its functional activity and the tax procedure itself. The legitimation given to the integration of intelligent systems cannot, however, fail to protect and promote the rights of those liable to tax. In a Democratic Rule of Law based on human dignity, the "objectification" of taxpayers is an insurmountable and inalienable limit that is not admissible. The tensions, the problems and the challenges faced by both interests that are placed in the legal chessboard legitimize the study and discussion on the integration of intelligent systems in the tax procedure, the reformulation of the administration's activity and the limits that must be considered in the adoption of these artificial intelligence mechanisms. |
