Resumo(s): | Esta tese procura destacar que, na economia gig, muitos trabalhadores estão subordinados ao
controle por algoritmos e são usurpados de seus direitos sociais, especialmente, os relacionados à
segurança e à saúde no trabalho. De vertente jurídico-dogmática, o estudo é desenvolvido em três
capítulos. Intenciona, inicialmente, apresentar como a economia gig se fortaleceu no mercado, quem
são os sujeitos envolvidos, a diversidade terminológica do fenômeno e as consequências na vida do
trabalhador. Em seguida, apresenta posicionamentos jurisprudenciais e doutrinários sobre as
contratações firmadas com as plataformas digitais, a fim de evidenciar diversas perspectivas para a
identificação da natureza jurídica e a compreensão do fenômeno. Posteriormente, objetiva ressaltar a
classificação correspondente para a relação jurídica decorrente do controle exercido pelas plataformas
digitais sobre o trabalhador. Com base nessa tríade dialógica, defende-se que as contratações firmadas
entre os trabalhadores e as plataformas virtuais nem sempre se apresentam distintas de uma clássica
relação de emprego advinda de um modelo fordista/taylorista de organização do trabalho. Para tanto, a
pesquisa se embasa nos elementos que consolidaram a noção de relação de emprego e justificam a
existência do Direito do Trabalho. Esses elementos esclarecem que a atual subordinação vivenciada pelo
trabalhador gig não necessita ser identificada sob uma perspectiva inovadora ou legislada, poisse adequa
aos padrões tradicionais. Conclui-se que a subordinação do trabalhador aos ditames das plataformas
digitais, ao mesmo tempo em que desvela um controle dos meios tecnológicos exercido pelo tomador de
serviços, é, paradoxalmente, um subterfúgio para o empreendimento digital negar responsabilidades com
respaldo na liberdade que a classe trabalhadora possui para definir seu tempo de trabalho. Na era do
Trabalho 4.0, a tecnologia não pode ser disruptiva das prerrogativas já alicerçadas pelo Direito do
Trabalho. Estas precisam ser destinadas, indistintamente, a todo trabalhador. This thesis seeks to highlight that, in the gig economy, many workers are subject to control by algorithms and usurped of their social rights, especially those related to safety and health at work. Under the principles of legal dogmatics, the study is developed into three chapters. Initially, it addresses how the gig economy gained strength in the market, who the subjects involved are, the diversity of terminology of the phenomenon and consequences in the worker's life. Following, it presents jurisprudential and doctrinal positions on contracts signed with digital platforms, in order to stress different perspectives for the identification of the legal nature and the understanding of the phenomenon. Subsequently, it aims to emphasize the corresponding classification for the legal relationship resulting from the control exercised by digital platforms over the worker. Based on this dialogical triad, it defends that the contracts signed between workers and virtual platforms are not always distinct from a classic employment relationship stemming from a Fordist/Taylorist model of work organization. Therefore, the research is built on the elements which consolidated the notion of employment relationship and which justify the existence of Labor Law. These elements clarify that the current subordination experienced by the gig worker does not need to be identified under an innovative or legislated perspective, as it fits the standard patterns. It concludes that the subjection of the worker to the dictates of digital platforms, while revealing a control of the technological means exercised by the service provider, is, paradoxically, a subterfuge for the digital enterprise to deny responsibilities supported by the freedom that the working class has to define their work time. In the era of Labor 4.0, technology cannot disrupt the prerogatives already supported by Labor Law. These must apply, without distinction, to every worker. |
