A culpa no crime de infanticídio: o caso especial de filho gerado através de ato sexual não consentido

Abstract

Na presente dissertação pretende-se analisar, de forma rigorosa e extensiva, no que consiste, juridicamente, o crime de infanticídio. Neste sentido, far-se-á uma abordagem histórica da sua criminalização e bem assim o estudo do seu atual enquadramento no Ordenamento Jurídico Português. Através de uma investigação sempre pautada pelos princípios da culpa no Direito Penal Português, concretizar-se-á ainda o que seja a “Influência Perturbadora do Parto” consagrada pelo legislador. Em parte, a investigação consistirá no estudo das perturbações psicológicas gestacionais e pós-parto, por forma a compreender os motivos que levam à prática do ilícito. Colocar-se-á ainda em discussão a circunstância especial desta mulher ter sido vítima de violação da qual resultou a sua gravidez, pretendendo-se com isto determinar os moldes em que decorrerá o julgamento e quais os meios probatórios utilizados para o efeito, sendo esta a verdadeira problemática a ser respondida. Para tal efeito, far-se-á um estudo constantemente pautado pela interdisciplina entre as Ciências Sociais e as Ciências Humanas, com o que se pretende dar uma resposta mais abrangente e completa a esta problemática.

This master’s dissertation aims to analyze, in a rigorous and extensive way, what the crime of infanticide legally consists of. In this sense, a historical approach to its criminalization will be made, as well as a study of its current framework in the Portuguese Legal System. Through a study always guided by the principles of guilt in Portuguese Criminal Law, a study of what is the "Disruptive Influence of Childbirth" enshrined by the legislator will also be carried out. In part, the investigation will consist of the study of gestational and postpartum psychological disorders in order to understand the reasons that lead to the practice of the illicit. The special circumstance of this woman having been the victim of the rape that resulted in her pregnancy will also be discussed, with the intention of determining the manner in which the trial will take place and which evidence will be used for this purpose, this being the real problem to be answered. For this purpose, a constant study will be carried out based on the interdisciplinary between the Social Sciences and the Human Sciences to giving a more complete answer to the problem presented.
