Resumo(s): | A Lei n.º 49/2018, de 14 de agosto, abolindo os anteriores institutos da
interdição e inabilitação, viria introduzir, no ordenamento jurídico português, o regime do maior acompanhado. Dos institutos clássicos aos ventos de mudança que chegavam da ordem jurídica internacional – designadamente da Convenção
das Nações Unidas sobre os Direitos das Pessoas com Deficiência – trilhamos os caminhos percorridos para a adoção deste novo modelo que se erige, hoje, sob o
estandarte do primado da autonomia do beneficiário, respeitando a sua vontade até aos limites do possível. A premissa parte, agora, da preservação máxima da
capacidade do maior, auxiliando-o no exercício dos seus direitos e no cumprimento
dos seus deveres, na medida do estritamente necessário, em obediência aos princípios da necessidade e subsidiariedade. E se muitas foram as potencialidades
que se avizinharam com a adoção desta reforma, longos serão ainda os passos a
serem dados quanto aos seus desafios e constrangimentos. Sobre tudo isto nos
versamos ao longo desta dissertação, fazendo uma exposição crítica do novo regime. Law No 49/2018, of 14 August, abolishing the orders of full and partial guardianship, introduced into the Portuguese legal system the new legal framework for adults with impairments. Starting from the traditional regulations and continuing through the changes brought about by the international legal system – namely, the United Nations Convention on the Rights of Persons with Disabilities – we will follow the steps which led to the introduction of this new model, which has been established under the banner of the primacy of the autonomy of those concerned, while respecting their will to the fullest extent possible. The premise is now based on the maximum preservation of the abilities of these persons in order to help them exercise their rights and fulfil their duties, to the extent strictly necessary and in obedience to the principles of necessity and subsidiarity. Even if the introduction of this reform has brought many opportunities, long is still the road to overcome its challenges and limitations. We will deal with all these aspects in the course of this dissertation while making a critical presentation of the new regulations. |
