Resumo(s): | O princípio da presunção de inocência, nos últimos anos no Brasil, esteve no centro de uma
das mais importantes discussões jurídicas travadas pelo Supremo Tribunal Federal brasileiro. Com muitas
idas e vindas, em meio a forte cobertura jornalística e social, acompanhou-se a discussão acerca da
flexibilização da exigência do trânsito em julgado para recolhimento do réu à prisão, após condenação em
segunda instância e antes do trânsito em julgado. Neste cenário, a presente dissertação busca apresentar
e analisar os argumentos lançados por ambos os lados do embate. Para tanto, utilizou como método de
investigação o fenomenológico-hermenêutico, através de estudos doutrinários, jurisprudenciais e
pesquisas empíricas relacionadas à temática. Em resultado aos esforços envidados neste estudo, concluiuse
pela ausência de permissivo constitucional, e mesmo legal expresso, ao recolhimento à prisão de réu
condenado em segunda instância, sem que tenha havido o imperativo da coisa julgada. The principle of the presumption of innocence, in recent years in Brazil, was at the centre of some of the most important legal discussions held by the Brazilian Federal Supreme Court. With many comings and goings, in the midst of strong journalistic and social coverage, there was a discussion about the easing of the requirement for res judicata to collect the defendant in prison, after conviction at second instance and before the res judicata. In this scenario, the present dissertation seeks to present and analyse the arguments launched by both sides of the struggle. To this end, it used the phenomenologicalhermeneutic method of investigation, through doctrinal, jurisprudential studies and empirical research related to the theme. As a result of the efforts made in this study, it was concluded that there was no constitutional, or even express legal, allowance for the defendant to be sentenced to prison in the second instance, without the need for res judicata. |
