Resumo(s): | A presente Dissertação tem como tema a Presunção de Inocência e a Execução Provisória da Pena em
Processo Penal: uma análise a partir dos Direitos Fundamentais. Está inserida na Linha de Pesquisa
Direito e Jurisdição, dentro da área de concentração Fundamentos do Direito Positivo, e é resultado das
pesquisas realizadas no curso de Mestrado do Programa de Pós-graduação Stricto Sensu em Ciência
Jurídica pela Universidade do Vale do Itajaí e no curso de Mestrado da Escola de Direito da Universidade
do Minho, como produto do convênio de dupla titulação entre essas universidades. Utiliza-se o método
indutivo para a elaboração do presente estudo. O objetivo primordial é verificar, à luz dos direitos
fundamentais, se há compatibilidade jurídica da execução provisória da pena em processo penal, após
a condenação em segundo grau de jurisdição, frente ao princípio da presunção de inocência, previsto no
art. 5º, LVII, da Constituição da República Federativa do Brasil de 1988, utilizando como paradigma o
direito estrangeiro, especialmente o ordenamento jurídico português. Inicialmente, apresenta-se um
aprofundado estudo sobre a teoria dos direitos fundamentais, conceitos, aspectos históricos, sua
construção e classificação, com enfoque na investigação sobre a materialização desses direitos, à luz da
teoria de Alexy, e consequente distinção entre norma-regra e norma-princípio, percorrendo, ainda, suas
implicações sob a ótica da esfera do não-decidível. Após, aprofunda-se a investigação sobre o princípio
da presunção de inocência, sua origem, evolução histórica e os sentidos que assume no direito
estrangeiro, fazendo-se breve análise a partir dos ordenamentos jurídicos da Argentina, Chile, Itália e
Espanha, com especial enfoque no ordenamento jurídico de Portugal, para, ao final, perscrutar seu
estudo no ordenamento jurídico brasileiro e o significado que assume o termo trânsito em julgado. Na
sequência, dedica-se especial atenção à investigação das prisões no direito brasileiro, iniciando-se com
a análise do conteúdo, forma e finalidades das prisões cautelares, e, após, também da prisão pena, com
enfoque nas teorias da pena e os fins materiais de restrição de liberdade que estas apresentam, para
então, compreender a distinção entre ambas. Por fim, a partir dos estudos realizados, faz-se o exame
acerca da compatibilidade jurídica da garantia da presunção de inocência e da execução provisória da
pena em processo penal após a condenação em segundo grau de jurisdição, concluindo-se pela violação
da norma inserida no art. 5º, LVII, da Constituição da República Federativa do Brasil. The theme of this dissertation is the Presumption of Innocence and the Provisional Execution of the Sentence in Criminal Proceedings: an analysis based on Fundamental Rights. It is part of the Line of Research Law and Jurisdiction, within the area of concentration Fundamentals of Positive Law, and is the result of research carried out for the Master's program of the Stricto Sensu Graduate Program in Legal Science at the University of Vale do Itajaí and the Master's Degree course of the University of Minho Law School, a product of the dual title agreement between the two universities. The inductive method was used for this study. The main objective was to investigate, in light of fundamental rights, whether there is legal compatibility of the provisional execution of the sentence in criminal proceedings after the conviction in the second degree of jurisdiction, in view of the principle of presumption of innocence provided for in art. 5, LVII of the 1988 Constitution of the Federative Republic of Brazil. Foreign law is used as a paradigm, especially the Portuguese legal system. Initially, an in-depth study is presented on the theory of fundamental rights, its concepts, historical aspects, construction and classification, focusing specifically on the materialization of these rights in light of Alexy's theory, and the consequent distinction between norm-rule and norm-principle. Its implications are also addressed from the perspective of the undecidable sphere. The focus then turns to the principle of presumption of innocence, its origin, and historical evolution, and the meanings it assumes in foreign law. A brief analysis is made of the legal systems of Argentina, Chile, Italy, Spain and Portugal, with special focus on the latter, before examining the Brazilian legal system and the meaning of the term transit in res judicata. Subsequently, imprisonment in Brazilian law is investigated, starting with an analysis of the content, form and purposes of preventive custody, before going on to analyze imprisonment sentences, focusing on theories of punishment and the material ends of restriction of freedom presented by each, and seeking to understand the distinction between them. Finally, based on the analyses, the legal compatibility of the guarantee of presumption of innocence and the provisional execution of the sentence in criminal proceedings after the conviction in the second degree of jurisdiction are examined, concluding with the violation of the rule inserted in art. 5, LVII, of the 1988 Constitution of the Federative Republic of Brazil. |
