Resumo(s): | As garantias dos contribuintes consubstanciam-se em todos os instrumentos ou mecanismos
disponibilizados pela ordem jurídica de forma compreensível, razoável e não arbitrária, determinável,
estável e previsível ao dispor dos contribuintes em defesa dos seus legítimos direitos e interesses. Estas
garantias não existiam no período antes do constitucionalismo. Porquanto, são firmadas com o
nascimento do Estado de direito democrático em que a Constituição da República é a lei suprema que
representa a expressão de uma vontade coletiva de todos os elementos que fazem parte do Estado. Por
isso, a Autoridade Tributária em caso algum atua arbitrariamente e põe em causa os legítimos direitos e
interesses dos cidadãos-contribuintes. A Autoridade deve, na sua atuação, zelar pelo interesse público e
pelo respeito dos direitos e garantias dos contribuintes que estão consagrados na Constituição da
República Democrática de Timor-Leste e nas outras legislações vigentes.
No ordenamento jurídico timorense, as garantias dos contribuintes dividem-se em dois grandes
grupos: as garantias gerais e as garantias especiais. O primeiro grupo compreende as garantias de
natureza jurídico-constitucional agregadas sob o poder tributário. Pois, o poder tributário em si é uma
garantia dos contribuintes, na medida em que a atribuição deste poder decorre da Constituição da
República apenas ao Estado – Parlamento Nacional. Estas garantias refletem-se nos fundamentos do
poder tributário e, em particular, nos limites da sua atuação. O segundo grupo abrange as garantias que
se materializam nos meios que possibilitam a suspensão da atuação da Autoridade Tributária (prestação
de caução) e nos meios procedimentais e processuais (garantias administrativas e garantias
contenciosas).
Estas garantias existentes devem ser melhoradas para melhor proteger a esfera jurídica dos
contribuintes. Para tal: i) é necessário reforçar as garantias gerais dos contribuintes mediante adoção do
princípio da legalidade fiscal sob forma de reserva absoluta da lei formal, concretizado pelo princípio da
tipicidade fechada, principalmente nas matérias de incidências; aditamentos das normas que garantam
o cumprimento do princípio da igualdade em matéria fiscal; e celebre mais acordos de dupla tributação
com os países amigos ou vizinhos; ii) necessita de autonomização do direito tributário que se concretiza
mediante a codificação do novo regime procedimento tributário, da lei processual tributária e fixação de
tribunais administrativos e fiscais. The taxpayers 'guarantees are embodied in all instruments or mechanisms available by the legal order in a manner that is comprehensible, reasonable and not arbitrary, determinable, stable and predictable at the taxpayers' disposal in defense of their legitimate rights and interests. These guarantees did not exist before constitutionalism. Therefore, they are affirmed with the appearance of the rule of democratic law in which the Constitution of the Republic is the supreme law that represents the expression of a collective will of all elements that are part of the state. Therefore, the Tax Authority is prohibited to acts arbitrarily and undermines the legitimate rights and interests of the taxpayer. The Authority, in his actions, must ensure the public interest and respect for the rights and guarantees of taxpayers that are enshrined in the Constitution of the Democratic Republic of Timor-Leste and other applicable laws. In the Timorese legal system, taxpayer guarantees are divided into two major groups: general guarantees and special guarantees. The first is the legal and constitutional guarantees aggregated under the tax power. For, the tax power itself is a guarantee of taxpayers, since the attribution of this power derives from the Constitution of the Republic only to the State - National Parliament. Nevertheless, these guarantees are reflected in the fundamentals of the tax power and, in particular, in the limits of its performance. The second is those that materialize in the means that make it possible to suspend the performance of the Tax Authority (rendering security) and in procedure and procedural means (administrative guarantees and contentious guarantees). These existing guarantees should be improved to better protect the taxpayer's legal sphere. To this end: i) needs to strengthen the general guarantees of taxpayers by adopting the principle of tax legality in the form of an absolute reservation of formal law embodied by the principle of closed typicality, especially in matters of incidence; additions of rules that ensure the equality principle in tax matters; and conclude more double taxation agreements with friendly or neighboring countries; ii) needs the autonomy of the tax law that is achieved through the codification of the new tax procedure regime, the tax procedural law and the establishment of administrative and tax courts. |
