O poder sancionatório desportivo no âmbito do futebol profissional em Portugal

Abstract

O poder disciplinar desportivo no âmbito do futebol profissional em Portugal goza de problemáticas que vão desde a interpretação constitucional dada ao ordenamento desportivo, e da sua reserva de jurisdição (desportiva), à própria aplicação das suas sanções que aparenta reclamar garantias processuais penais ao mesmo tempo que apresenta características marcadamente administrativas. É, pois, um tema de amplo interesse que, à semelhança do direito das contraordenações, se encontra num ramo do direito ainda pouco explorado, pelo que se procurará aqui tecer algumas considerações relativas às soluções legais encontradas para as problemáticas que se lhe apresentam, nomeadamente com recurso à comparação entre os respectivos regimes sancionatórios.

The disciplinary power of sport in the field of professional football in Portugal has doutrinary problems ranging from the constitutional interpretation given to the sport order, and its reserve of (sports) jurisdiction, to the very application of its sanctions that demand criminal procedural guarantees given that at the same time has markedly administrative characteristics. It is, therefore, a topic of wide interest that, similar to the portuguese law of administrative infractions, is in a field of law still little explored, so we will try to make some considerations regarding the legal solutions found to the problems that arise, namely comparing the respective sanctioning regimes.
