Resumo(s): | Este trabalho tem como pano de fundo a crise econômica, política e jurídica vivenciada pelo Estado
brasileiro desde o ano de 2015. Tal crise desencadeou certa instabilidade entre os Poderes da República
no Estado democrático de direito, o que impactou reflexamente na Justiça do Trabalho, sobretudo em
razão da insegurança jurídica que se seguiu à aprovação da Lei n.º 13.467/2017.
A nova legislação alterou substancialmente diversos institutos jurídicos consagrados na seara trabalhista
e, por essa razão, importa questionar sobre qual seria a interpretação juridicamente adequada a partir
desse novo padrão normativo, a fim de que não se comprometa o direito fundamental de acesso à Justiça
e a independência funcional dos juízes do trabalho.
Importa, portanto, avaliar o corte orçamentário realizado no ano de 2016 para com a Justiça do Trabalho,
assim como alguns artigos da Reforma Trabalhista aprovada no ano de 2017, especialmente no que diz
respeito à independência funcional de magistrados do trabalho e ao direito de acesso à Justiça por parte
dos trabalhadores.
Quanto à interferência na atividade judicante de magistrados trabalhistas, importa sobretudo escrutinar
a nova previsão legal sobre a delimitação do quantum debeatur dos danos morais causados aos
trabalhadores, bem como a restrição imposta à apreciação do conteúdo da negociação coletiva de
trabalho pela Justiça, além dos novos requisitos criados e exigidos para a edição de súmulas pelos
Tribunais do Trabalho.
No que concerne ao direito de acesso à Justiça por parte dos trabalhadores, importa verificar as
mudanças no instituto de gratuidade da Justiça e sua compatibilidade com a Carta Constitucional
brasileira, bem como a previsão legal sobre os novos mecanismos que extinguem, extrajudicialmente, o
crédito trabalhista, como a cláusula de arbitragem, o Plano de Demissão Voluntária e a quitação anual
dada ao contrato de trabalho. Importa ainda aferir em que medida a prescrição intercorrente (que é
aquela que ocorre no curso do processo de execução trabalhista), conjugada com a nova previsão legal
de redução do início da fase executiva de ofício por parte do juiz do trabalho, interfere no direito de acesso
ao Poder Judiciário.
A presente dissertação sugere uma nova abordagem hermenêutica da nova legislação, tendente a afastar
as interpretações inconstitucionais e/ou contrárias aos Direitos Humanos e aos princípios específicos da
seara trabalhista. The present work aims to analyze how the economic, social and political crisis experienced by the Brazilian State since the year 2015 triggered a certain instability between the Powers of the Republic in the democratic State of law and impacted reflexively in the Labor Court due to legal uncertainty which came about with the approval of the Law 13.467 / 2017. The new legislation has substantially altered several legal institutes that have been enshrined in the labor law and, for this reason, it is questioned as to what interpretation should be given to the law from this new perspective to not compromise the fundamental right of access to justice and the functional independence of labor judges. From this perspective, it is important to evaluate the Labor Court budget cut of 2016, as well as some articles of the Labor Reform approved in 2017, especially with regard to the functional independence of labor magistrates and the workers’ right of access to justice. Concerning the interference in the judicial activity of labor magistrates, the new legal provision expressed in the Consolidation of Labor Laws about the delimitation made to the quantum debeatur to the moral damages caused to the workers and the restriction imposed for the appreciation of collective work agreement for Justice, will be verified, as well as the new requirements created and required for the issue of precedents by the Labor Court. Regarding the workers right of access to justice, this paper aims to verify the changes in the free access to justice and its compatibility with the Brazilian Constitutional Letter, as well as to study the legal prediction about the new mechanisms that extinguish extrajudicially the labor credit, such as the arbitration clause, the Voluntary Resignation Plan and the annual discharge given to the employment contract. In addition, it was sought to determine the extent to which intercurrent prescription (which is that occurring in the course of the labor enforcement process), coupled with the new legal provision to reduce the start of the ex officio executive phase by the labor court, interferes with the right of access to the Judiciary System. Finally, the present scientific investigation suggests a new hermeneutic approach of the new legislation tending to surpass the unconstitutional interpretations and / or contrary to the Human Rights and the specific principles of the labor court. |
