As cláusulas contratuais gerais e os seguros de grupo contributivo: tutela do aderente: relatório de atividade profissional

Abstract

O presente relatório versa sobre a minha experiência profissional como Juiz de Direito e tem como objetivo proporcionar uma perspetiva, necessariamente incompleta, desta missão, tão incompreendida pelo cidadão comum, que consiste em interpretar e aplicar o Direito de modo a assegurar a realização da Justiça. Tentarei caracterizar as várias comarcas onde exerci funções ao longo dos últimos vinte anos e os desafios que cada uma representou, bem como o nível de desempenho alcançado, traduzido na produtividade e qualidade das decisões proferidas. Proponho-me igualmente salientar alguns casos curiosos com que me defrontei, quer pela complexidade das questões jurídicas que neles se suscitavam, quer pela sua originalidade. Por último, farei uma breve exposição sobre a problemática das cláusulas contratuais gerais e os seguros de grupo contributivo em face do regime instituído pelo DL 176/95, de 26 de Julho, com as alterações introduzidas pelo DL 60/2004, de 22 de Março, e pelo DL 357-A/2007, de 31 de Outubro, e do regime que o substituiu, criado pelo DL 72/2008, de 16 de Abril. Explicitarei a indefinição reinante na jurisprudência, nomeadamente no que concerne à definição dos sujeitos do dever de informação e às consequências do incumprimento desse dever, e procurarei fornecer pistas sobre qual a melhor interpretação do quadro legal vigente no sentido de assegurar a imprescindível proteção do aderente, que é inequivocamente a parte contratual mais fraca.

The present report is about my professional experience as a Judge and has the objective of providing a view, necessarily incomplete, of this mission that is misunderstood by the common citizen. A mission that consists of applying the Law so the realization of the Justice is assured. I will try to characterize the several judicial districts where I have exert my duties for the last twenty years and the challenges that each one represented, as well as the performance level achieved, based on the productivity and on the quality of the decisions that were made. I also propose to point out some curious cases that I have been faced with, either by the complexity of the legal questions that raised them or by their originality. At last, I will do a short exposition of the problem that are the general contract terms and the contributory insurance group according to the system created by the DL 175/95, 26 July, with the changes inserted by the DL 60/2004, 22 March, and by the DL 357-A/2007, 31 October, and the system that replaced it, introduced by DL 72/2008, 16 April. I will also try to explain the uncertainty that reins the Jurisprudence, especially in what concerns the definition of the subjects of the duty of disclosure and the consequences of failing that duty, and giving clues about the best interpretation of the existing legal framework in an effort to ensure the indispensable protection of the adherent that is, roundly, the weakest contractual part.
