Resumo(s): | Esta dissertação procura fazer uma análise atual do panorama das Convenções para Eliminar a Dupla
Tributação e o combate aos esquemas abusivos por parte dos contribuintes. Para tal compreensão,
conceitos como “dupla não tributação” e “abuso de tratados” são fundamentais para este estudo
assim como as medidas de combate a estes fenómenos ao nível do Direito Internacional Fiscal. Apesar
das anteriores preocupações dos Estados os passos dados a nível legislativo internacional a este
respeito foram sempre amenizados pela soberania fiscal e pela adoção de medidas domésticas. Não
obstante, alguns passos foram dados pela OCDE pela inclusão de algumas, embora um pouco
camufladas, medidas anti abuso.
Deste modo, a OCDE desenvolveu o Plano de Ação “Base Erosion and Profit Shifting”(BEPS) no sentido
de combater alguns fenómenos que originam situações patológicas e harmonizar as normas fiscais
internacionais relativa à dupla tributação, e consequentemente, à dupla não tributação. A Ação 6 deste
Plano de Ação procurou exatamente combater a utilização abusiva das normas dos tratados por parte
dos contribuintes, propondo medidas para combater estes comportamentos, sobre as quais este
estudo se debruçará. Por seu lado, a Ação 15 do aludido plano resultou numa compilação normativa,
denominada Convenção Multilateral para Prevenir a Erosão das Bases Tributárias e a Transferência de
Lucros, ou “The Multilateral Instrument”. Esta compilação abarca várias normas no sentido de
combater o abuso de tratados e melhorar a conjugação entre os diferentes sistemas tributários, assim
como as lacunas provocadas pelas suas diferenças, e principalmente, como já referido, a utilização
abusiva dessas lacunas.
A dissertação estudará as normas introduzidas para combater o abuso de tratados, o tipo de normas,
como estas se aplicarão e como irão interagir com as convenções bilaterais.
Será feita também uma análise à interação destas normas com as normas europeias anti abuso, uma
vez que podem levantar algumas dúvidas de interpretação e contradições com os direitos fundamentais
europeus. Assim como uma análise da interação com os outros tratados, nomeadamente os tratados
fiscais. This study seeks to make a current analysis of the panorama of the Conventions to Eliminate the Double Taxation and the combat to the abusive schemes on the part of the taxpayers. For this understanding, concepts such as "double taxation" and "abuse of treaties" are fundamental to this study as well as measures to combat these phenomena in the area of International Tax Law. Despite previous concerns of the States, the steps taken at the international legislative level in this regard have always been softened by fiscal sovereignty and the adoption of domestic measures. Nonetheless, some steps were taken by the OECD to include some, albeit slightly camouflaged, anti-abuse measures. The OECD has therefore developed the "Base Erosion and Profit Shifting" Action Plan (BEPS) to combat some of the phenomena that give rise to pathological situations and to harmonize international tax rules on double taxation and, consequently, double non-taxation. Action 6 of this Plan of Action sought precisely to combat abusive use of treaty standards by taxpayers, proposing measures to combat these behaviors, on which this study will focus. For its part, Action 15 of the plan resulted in a normative compilation, called the Multilateral Convention to Prevent Tax Erosion and Profit Transfer, or "The Multilateral Instrument." This compilation covers a number of rules to combat abuse of treaties and to improve the combination of different tax systems, as well as the gaps caused by their differences, and above all, as mentioned above, the misuse of such gaps. The dissertation will study the norms introduced to combat treaty abuse, the type of rules, how these will apply and how they will interact with bilateral conventions. An analysis will also be made of the interaction of these standards with European anti-abuse standards, as they may raise some doubts of interpretation and contradictions with European fundamental rights. As well as an analysis of the interaction with the other treaties, in particular tax treaties. |
