A vítima de crimes contra a autodeterminação sexual no sistema de justiça

Abstract

Este estudo teve como objetivo principal compreender como a vítima de crimes contra a autodeterminação sexual é concetualizada por juízes e magistrados. Assim, procuraremos analisar como a vítima destes crimes é tratada nos acórdãos, estudando a linguagem utilizada e verificando a presença de fatores legais, psicossociais, crenças e estereótipos, através da Análise Temática. Foram identificados seis temas principais: (i) Resposta emocional/Postura durante as declarações; (ii) Referência a aspetos do contexto aquando dos atos; (iii) Capacidade de testemunho e Credibilidade das declarações; (iv) Motivação/contexto da queixa ou manutenção do segredo; (v) Caraterização da vítima: Trajetória pessoal e (vi) Impacto na vítima. Em geral, foi possível verificar a presença de fatores legais e psicossociais, estes últimos resultando geralmente na culpabilização da vítima e na legitimação da violência sexual.

This study aimed to understand how underage victims of sexual crimes are conceptualized by judges and magistrates. We analyzed how the victims of these crimes are treated on sentences, studying the language used and verifying the presence of legal and psychosocial factors, beliefs and stereotypes, through thematic analysis. Six main themes were identified: (i) Emotional response/Posture during statements; (ii) Reference to context aspects at the time of the abuse; (iii) Witnessing capacity and credibility of declarations; (iv) Motivation/context of report or maintenance of secrecy; (v) Characterization of the victim: Personal trajectory and (vi) Impact on the victim. In general, it was possible to verify the presence of legal and psychosocial factors, the latter usually resulting in blaming the victim and legitimizing sexual violence.
