Resumo(s): | A Lei n. º 41/2013, de 26 de junho, publicou o novo Código de Processo Civil. Uma
das suas novidades é a introdução da inversão do contencioso no âmbito dos procedimentos
cautelares, que veio alterar o paradigma até então vigente. Além de ter objetivos claros de
prossecução da celeridade processual, a inversão do contencioso veio quebrar com a relação
de dependência, instrumentalidade e provisoriedade que era característica dos procedimentos
cautelares com a ação principal.
De acordo com o art. 369.º do CPC, se o requerente de uma providência cautelar
requerer a inversão do contencioso até ao encerramento da audiência final, o juiz, se formar
uma convicção segura acerca da existência do direito do requerente e a providência for
adequada a compor definitivamente o litígio, poderá dispensar o requerente da providência
do ónus de propor a ação principal. Esse ónus passará a pertencer ao requerido, que se não
intentar a ação principal dentro do prazo, fará com que a providência se consolide e passe a
compor definitivamente o litígio.
A nível do processo laboral ainda não houve nenhuma alteração legislativa que
adequasse o CPT às novas alterações vigentes no CPC. Deste modo, o objeto central do nosso
estudo será averiguar da aplicabilidade da inversão do contencioso nos procedimentos
cautelares laborais, quer no procedimento cautelar comum, quer nos procedimentos
especificados previstos no CPT. The Law n. º 41/2013 of the 26th June, has published the new Civil Procedure Code (CPC). One of his novelty is the introduction of the reversal of litigation in the precautionary proceedings, who have changed the paradigm existing so far. Besides the clear purpose of pursuing procedural promptness, the reversal of litigation broke the relation of dependency, instrumentality and temporariness between the main action and the precautionary proceeding. According the article 369.º of the CPC, if the applicant of a protective order requests a reversal of litigation, the judge, if he forms a secure conviction about the existence of the right to protect and the protective order is suitable to achieve the final resolution of the litigation, can dismiss the applicant of the burden of lodging the main action. This burden will belong to the respondent. If the respondent doesn’t institute the main action in the established deadline, the protective order will consolidate and solve the litigation for good. In the labour procedure, there is still no legislative change who adequate the Labour Procedure Code (CPT) to the new changes now in force on the CPC. That way, the main purpose of our study is to find out if the reversal of litigation is applicable in the labour precautionary proceedings, not only in the common precautionary proceeding but also in the specified proceeding provided in the CPT. |
