dc.description.abstract | Inicialmente formulado em uma concepção abstrata e generalista, o sistema internacional de proteção dos direitos humanos foi se desenvolvendo e especificando para abranger as diferenças de indivíduos e sociedades. Nesse sentido, foi importante o movimento por uma maior atenção às necessidades e interesses das mulheres e consequentemente pela promoção dos seus direitos humanos, os quais incluem os denominados direitos reprodutivos. Atualmente, a proteção dos direitos reprodutivos das mulheres enfrenta novos desafios face aos avanços nas tecnologias reprodutivas, uma vez que estas, ao permitir que se alcancem os fins reprodutivos sem atividade sexual, trazem uma série de questões para a ideia de liberdade e autonomia reprodutiva. Assim, com base no marco histórico do desenvolvimento dos direitos humanos da mulher no Direito Internacional dos Direitos Humanos e tendo em conta a perspectiva de género, este estudo tem como objetivo analisar a proteção dos direitos reprodutivos das mulheres em Portugal, particularmente o papel que mudanças recentes na lei da procriação medicamente assistida, em virtude da promulgação das leis n.º 17/2016 e n.º 25/2016, tem desempenhado na promoção de maior igualdade de género no âmbito destes direitos. | por |
dc.description.abstract | Initially formulated in an abstract and generalist conception, the international system for the protection of human rights was developed and specified in order to encompass the differences of individuals and societies. In this sense, the movement for greater attention to the needs and interests of women and consequently for the promotion of their human rights, which includes the reproductive rights, was particularly relevant. Currently, the protection of women's reproductive rights faces new challenges as a result of advances in reproductive technologies, since by allowing reproduction without sexual activity, many new questions, concerning freedom and reproductive autonomy are raised. Thus, based on the historical framework of the development of women's human rights in the International Human Rights Law and taking into account a gender perspective, this study aims to analyze the protection of women´s reproductive rights in Portugal, particularly the role that recent changes in the portuguese law on medically assisted procreation, due to the enactment of the laws n.º 17/2016 and n.º 25/2016, have played in promoting greater gender equality within the scope of these rights. | por |
