O direito à liberdade de expressão: a Influência do conceito de moral nas restrições legais à liberdade de expressão artística

Abstract

A arte é um veículo fundamental para o desenvolvimento e expressão do ser humano bem como para o ideal funcionamento das sociedades democráticas. Em decorrência, pois, da importância que a arte assume para a Humanidade, o direito à liberdade de expressão artística está contemplado, ora de forma explícita ora implicitamente, na grande maioria dos instrumentos de proteção de direitos humanos, tanto a nível universal, como regional e estadual. Contudo, tais instrumentos são os mesmos que “abrem a porta” a restrições da liberdade de expressão com base na necessidade de salvaguardar uma moral tendencialmente religiosa ou sexual. Não existindo um estatuto especial que confira à liberdade de expressão artística proteção perante a moral, este direito fundamental encontra-se, em virtude das especificidades da arte (que não raras vezes é subversiva), muito exposto à censura da moral. Nos mecanismos que legitimam tais interferências com o direito à liberdade de expressão, está incluída a Convenção Europeia dos Direitos do Homem. É nela que se baseia a atuação e as decisões do Tribunal Europeu dos Direitos do Homem (TEDH). Idealmente, o mesmo desempenharia um papel da máxima importância como protetor da liberdade de expressão artística. No entanto, quando confrontado com casos em que este direito se contrapõe à alegada necessidade de proteção da moral, o TEDH demonstra, essencialmente, que o direito à liberdade de expressão artística não constitui uma das suas prioridades e manifesta uma excessiva deferência para com a margem de apreciação dos estados quando em causa está a determinação do significado de moral.

Art is a fundamental vehicle for the development and expression of the human being as well as to the ideal functioning of democratic societies. Due to the key importance of art to Humanity, freedom of artistic expression is contemplated, explicitly or implicitly, in the great majority of human rights instruments, at the universal as well as the regional and state levels. However, such are the same instruments that enable restrictions to freedom of expression based on the necessity of safeguarding a tendentially religious and sexual morality. A special statute to artistic freedom of expression before morality is not granted, hence, this fundamental right is very exposed to the censorship of morality, due to the specificities of art (not infrequently subversive). The European Convention on Human Rights is included in the mechanisms that legitimize such interferences with the right to freedom of expression. The procedures and decisions of the European Court of Human Rights (ECHR)are based on the Convention. Ideally, the ECHR would play a role of the utmost importance as a protector of artistic freedom of expression. Although, when confronted with cases of opposition between this right and the alleged need of protecting morality, the ECHR mainly proves the right to artistic freedom of expression is not one of its priorities and manifests an excessive deference to the states’ margin of appreciation when it comes to determine the meaning of morality.
