Resumo(s): | O presente trabalho tem em vista analisar o que é a infertilidade e o papel que as
técnicas de Procriação Medicamente Assistida têm na resolução dos problemas de
infertilidade humana, ao facilitarem o processo de procriação quando outras medidas
não se mostraram suficientes para alcançar o tão desejado objetivo: ter um filho.
Com particular cuidado trataremos a temática maternidade de substituição, uma
vez que esta figura é a única forma de as mulheres que nasceram sem útero ou que o
perderam em consequência de uma lesão ou de uma doença serem mães. Para estas
mulheres não existe outra forma de realizar o desejo de terem um filho biológico.
A maternidade de substituição suscita um conjunto de questões éticas, morais,
sociais e jurídicas de difícil solução, pois põe em causa muitos dogmas ancestrais, mas
não deverá ser por isso que a resposta passará por proibir o recurso a tal instituto. Até
porque perante a proibição de utilizar este instituto fica aberta a janela para que quem
enfrenta este problema se desloque a um país em que a maternidade de substituição é
permitida, com todos os custos e riscos que lhe são inerentes, para não falar das
dificuldades que podem ocorrer a nível registal.
O recurso à maternidade de substituição é uma realidade a que o legislador
ordinário deverá estar atento, dando respostas aos problemas concretos que se colocam. The following paper as the purpose to analyze what infertility is and the role of Medically Assisted Procreation as a resolution to human infertility by making the process of procreation simpler when other attempts have failed the desired objective: having a child. This issue of surrogate motherhood will be dealt with a lot of care since that this mechanismis the only way for women that were born without a uterus or that have lost it after a lesion or an illness to become mothers. For these women there is no other way of fulfilling their desire of having a biological child. Surrogate motherhood unravels a great amount of questions regarding to ethic, moral, social and legal and there is no easy solution for this: it goes against many ancestral design but the use of such a institute should not be forbidden because of these problems. Since by not allowing the use of such institutes it may open a window for the people that face all this problems to go to another country where maternal substitution is allowed, with all the costs and risks that come from the procedure, not to mention the difficulty of registering the new born citizen. By using surrogate motherhood it’s a reality that the common legislator needs to be watchfull and giving answers based on the concrete problems that are placed before him. |
