Resumo(s): | A precariedade laboral tem-se vindo a agravar em Portugal. A atual crise que
vivemos, e que parece não ter fim, apresenta-se como a principal causa da precaridade
laboral.
As condições que os trabalhadores encontram no seu trabalho têm vindo a
deteriorar-se, o emprego é cada vez menor e o número de desemprego é cada vez maior.
Para se fazer frente à crise económica, que teima em pairar sobre nós, muitos
empregadores evitam contratar trabalhadores, utilizando deste modo o contrato de
prestação de serviços que assegura a continuidade das suas empresas sem terem de arcar
com os custos que um contrato de trabalho acarreta, surgindo, assim, os comummente
designados “falsos recibos verdes”.
Com o intuito de se combater esta realidade surgiu a Lei n.º 63/2013, de 27 de
agosto, que criou a nova “ação de reconhecimento da existência de contrato de trabalho”.
Exploraremos neste estudo esta nova ação que se apresenta desafiante e protetora
dos direitos dos trabalhadores.
No final, esperamos contribuir para um melhor entendimento das questões que
esta nova e peculiar ação tem levantado entre nós. Job insecurity has worsened in Portugal. The current crisis we live in, which seems to have no end, shows up as the main cause of labor precariousness. The conditions faced by workers in their workplace have been deteriorating, employment is declining and the number of unemployment is increasing. To deal with the economic crisis, which keeps on hovering over us, many employers avoid hiring workers with an employment contract, using instead an independent form of contract based on service agreement. This ensure the continuity of their businesses without having to bear the costs that an employment contract entails, thus arising the so-called “False Grein Receipts”. In order to fight against this reality, Law nº 63/2013 of August 27th has emerged, which created the new "Action for the Recognition of Employment Contract Existence”. This study will explore this new action which is challenging and protective of workers’ rights. In the end, we hope to contribute to a better understanding about the issues that may arise with this new and special action. |
