Resumo(s): | O presente trabalho corresponde ao relatório para obtenção do grau de Mestre em
Direito pela Escola de Direito da Universidade do Minho, no âmbito do mestrado Direito dos
Contratos e da Empresa.
A autora descreve o seu percurso profissional enquanto juiz durante cerca de vinte
anos. Após, partindo da sua experiência profissional, analisa o tema das consequências da
mora do segurador no âmbito do contrato de seguro. Este tema é abordado atendendo ao atual
regime do contrato de seguro no direito português e às soluções que foram adotadas noutros
ordenamentos jurídicos, sendo a resposta encontrada no domínio dos deveres laterais da
relação contratual.
A análise das consequências da mora do segurador surge em razão dos frequentes
atrasos na regulação de sinistros por parte do segurador. A ressarcibilidade dos danos
decorrentes da mora tem encontrado na doutrina e jurisprudência respostas negativas,
denotando resistência forte a outras soluções, que seriam mais harmoniosas com a tendência
europeia e com a ordem normativa da responsabilidade contratual. Uma reflexão aturada,
atualista e comparada, impelida por imperativos de justiça, leva a considerar esse
ressarcimento.
A opção pela análise da extensão da indemnização decorrente da mora do segurador
em confronto com o princípio da boa fé, representando uma transferência para o campo
contratual do princípio neminem laedere, resulta do facto de ser uma realidade que vem
assumindo particular relevo no âmbito do Novo Regime do Contrato de Seguro, aprovado pelo
Decreto-Lei n.º72/2008, de 16 de abril. The present work is the report to obtain the Master degree in School of Law of the University of Minho, under the Master Law of Contracts and the Company. The author describes her professional career while judge for about twenty years. After, on the basis of their professional experience, analyzes the theme of the consequences of late payment by the insurer under the insurance contract. This theme is discussed in view of the current scheme of insurance contracts in Portuguese law and the solutions that have been adopted in other legal systems, being the answer found in the area of secondary obligations of the contractual relationship. The analysis of the consequences of late payment by the insurer arises because of the frequent delays in the regulation of claims. Compensation for damage resulting from the delay has found in the doctrine and jurisprudence negative responses, denoting strong resistance to other solutions, which would be more harmonious with the european trend and with the normative order of contractual liability. A mature, modern and comparative reflection, impelled by imperatives of justice, leads to consider this compensation. The option by the analysis of compensation due to the delay of the insurer in confrontation with the principle of good faith, representing a transfer to the contractual domain of the principle neminem laedere, results from the fact that it is a reality that comes assuming particular importance in the context of the New Regime of the Insurance Contract, approved by Decree-Law n.º72/2008 of 16 April. |
