Resumo(s): | Na sequência da reconceptualização da segurança que ocorre na última década do
século XX, certificando uma posição central ao indivíduo na arena internacional,
verifica-se um momento de alteração do entendimento e reconhecimento referente à
utilização intencional da violência sexual como ferramenta de guerra em situação de
conflito armado.
As atrocidades perpetradas nas zonas de conflito (atrocity zones) da Bósnia-
Herzegovina (1992-1995) e do Ruanda (1994), integrando comportamentos de violação
como componente nuclear de estratégias político-militares calculadas (nítido desafio às
noções convencionais de segurança), provocaram uma resposta internacional que
culmina na instituição dos Tribunais Ad Hoc para a antiga Jugoslávia e para o Ruanda,
intentando a identificação e responsabilização dos respetivos agentes. Os avanços
jurisprudenciais tangentes ao crime de violação, decursivos do trabalho destes
Tribunais, nomeadamente a sua consagração direta e explícita enquanto atrocidade
(atrocity crime), compõem um esforço notório na procura da maximização da proteção
dos indivíduos (na condição de civis) em contexto de conflito.
Os desenvolvimentos aludidos constituem-se como base e impulsionadores da recente
tendência jurídica que emerge na década de 90, cuja formação sucede como objeção e
resposta à impunidade dos perpetradores de atrocidades que ameaçam
significativamente a Segurança Humana. Atentando à centralidade do indivíduo que lhe
é intrínseca, o Regime Internacional de Atrocidades é passível de funcionar como
promotor de segurança da pessoa humana. Following the reconceptualization of security that occurs in the last decade of the twentieth century, making sure the individual a central position in the international arena, there is a moment of change in understanding and recognition regarding the intentional use of sexual violence as a tool of war in armed conflict situation. The atrocities perpetrated in conflict zones (atrocity zones) of Bosnia-Herzegovina (1992-1995) and Rwanda (1994), integrating behaviors of rape as a nuclear component of calculated political-military strategies (clear challenge to conventional notions of security), provoked an international response that culminates in the establishment of the Ad Hoc Tribunals for the former Yugoslavia and Rwanda, intending the identification and accountability of the respective agents. The tangent to the crime of rape, stemming from the work of these courts, jurisprudential advances including its direct and explicit consecration while atrocity (atrocity crime), make up a major effort in the pursuit of maximizing the protection of individuals (as civilians) in armed conflict context. The alluded developments constitute themselves as a base and drivers of the recent legal trend that emerges in the 90s, whose formation occurs as an objection and response to impunity for the perpetrators of atrocities that significantly threaten Human Security. Bearing in mind the centrality of the individual, the International Atrocities Regime is likely to function as security provider of the human person. |
